Terms of Service

What this is
Family, Wherever (“the Service”) is a personal hobby project in closed beta, operated by an individual developer (“Operator”). It helps small groups plan trips together. It is not a company, not a commercial product, and not supported by a team.
The Service is experimental and may contain bugs, incomplete features, or data loss. It is a coordination tool provided for convenience only — it does not verify or guarantee the accuracy of travel information and should not be relied upon for critical travel decisions.
The Service is operated from the United States. The Service does not provide travel, financial, or professional advice.
By creating an account or continuing to use Family, Wherever, you agree to these terms.
Eligibility
You must be at least 13 years old to create an account or use the Service. If the Operator learns that an account belongs to someone under 13, the account will be deleted.
The service is provided as-is
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. There are no guarantees of:
- Uptime or availability
- Data preservation or backup
- Feature continuity
- Accuracy of any information processed by the Service (including email parsing)
The Service may go down, lose data, change significantly, or shut down entirely — at any time, for any reason, with or without notice.
The Service is operated voluntarily in the Operator’s spare time. The Operator has no obligation to continue operating, maintaining, supporting, or updating the Service and may discontinue it permanently at any time without liability.
Your use of the Service is entirely at your own risk.
Your account
You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
The Operator may suspend or terminate your account at any time, with or without cause, at sole discretion. If your account is terminated, you may lose access to all data associated with it.
Accounts that have been inactive for 12 months or more may be deleted, along with all associated data. The Operator will attempt to notify you by email before deletion.
Your content
You retain ownership of content you add to Family, Wherever (trip details, messages, bookings, etc.). By adding content, you grant the Operator a non-exclusive, worldwide, royalty-free license to store, display, and process it as necessary to operate the Service, for as long as the content remains in the Service.
You are responsible for any content you add. Do not add content that is illegal, harmful, or violates the rights of others.
When you leave or are removed from a trip, you may choose whether your content remains visible to other trip members or is removed. Chat messages remain regardless of this choice, as removing them would disrupt conversations for other members.
Prohibited conduct
You agree not to:
- Use the Service to harass, threaten, or abuse other users
- Send unsolicited or spam invitations
- Attempt to access other users’ accounts or data
- Probe, scan, or test the security of the Service
- Use bots, scrapers, or automated tools to access the Service
- Use the Service for illegal activity or to violate the rights of others, including intellectual property rights
- Interfere with the operation of the Service
Violation of any of the above is grounds for immediate account termination.
Other people’s content
Trip data is shared among trip members. You may see content added by others, including names, travel details, and messages. You agree not to disclose or misuse other members’ personal information obtained through the Service.
Third-party services
The Service may reference or interact with third-party services, including email providers, mapping services, and travel booking platforms. The Operator is not responsible for the content, accuracy, availability, or practices of those services.
Privacy
The Service is designed to collect limited information needed to operate: your name, email address, and the trip content you add. The Operator does not sell your data and does not run analytics or tracking beyond what is needed to operate the Service.
If you would like a copy of your personal data or would like it deleted, contact the Operator through the Service. The Operator will attempt to accommodate requests, but makes no guarantees regarding response time. Data requests cover your own data only — not other trip members’ information. Deletion may not remove all residual copies from backups or server logs.
Changes to the service
The Operator may change, limit, or discontinue any part of the Service at any time. Features may be added, changed, or removed without notice.
Changes to these terms
These terms may be updated at any time. If significant changes are made, you will be notified through the Service. Continued use after changes constitutes acceptance. If you do not agree with updated terms, stop using the Service.
Limitation of liability
To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, travel disruption, or lost profits, arising out of or related to your use of the Service — regardless of the cause of action or theory of liability.
In no event shall the Operator’s total aggregate liability for any claim or cause of action relating to the Service exceed one hundred US dollars ($100 USD).
Indemnification
You agree to indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your violation of these terms, or your violation of any law or third-party rights.
Force majeure
The Operator is not responsible for any failure or delay resulting from events beyond reasonable control, including but not limited to service outages, infrastructure failures, natural disasters, or internet disruptions.
Copyright
The Operator respects intellectual property rights. If you believe content on the Service infringes your copyright, contact the Operator at hello@famwherever.com with a description of the material and your ownership claim. The Operator will respond to notices of alleged copyright infringement in accordance with applicable law and may remove allegedly infringing material or terminate repeat infringers where appropriate.
Intellectual property
The software, design, and functionality of the Service are owned by the Operator and protected by intellectual property laws. You may not copy, modify, reverse engineer, or redistribute the Service except as permitted by these terms.
Dispute resolution
Any legal action arising out of or relating to the Service must be brought exclusively in the state or federal courts located in New York, New York. You consent to the jurisdiction of those courts.
You agree not to participate in any class action lawsuit or class-wide legal proceeding against the Operator.
No waiver
The failure of the Operator to enforce any provision of these terms shall not be considered a waiver of that provision.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire agreement
These terms constitute the entire agreement between you and the Operator regarding the Service and supersede any prior agreements, communications, or understandings, whether written or oral.
Assignment
The Operator may assign or transfer rights and obligations under these terms, including in connection with a sale or transfer of the Service, without restriction. You may not transfer your account or any rights under these terms to another person.
Survival
The following sections survive termination of your account or these terms: Limitation of Liability, Indemnification, Dispute Resolution, Intellectual Property, No Waiver, Severability, and Governing Law.
Governing law
These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
